PhoneArena's Privacy Policy is designed to help you understand how we collect and use the personal information you decide to share, and help you make informed decisions when using PhoneArena.
By using or accessing PhoneArena, you agree to be bound by the terms of this Privacy Policy. If you are a resident of certain jurisdictions including California, Virginia, Colorado, Connecticut, Utah, Nevada, Texas, Oregon, Montana, and such other U.S. states that have comparable consumer privacy laws, the European Economic Area (EEA), United Kingdom (UK) or Switzerland, please see the additional disclosures in this Privacy Policy.
Information We Collect and How We Use It
We use commercially reasonable efforts to ensure that the collection of personal information is limited to that which is necessary to fulfill the purposes identified below. If we use your information in a manner different than the purpose for which it is collected, then we will ask you for your consent prior to such use.
Account information - To take advantage of certain features offered on PhoneArena, such as uploading photos or videos, you need to create a User account. When creating a User account, we ask for and record personal information such as your name, email address and password. As an alternative, you can instead sign up by linking your Facebook, Google, or other third-party accounts. By linking the services, you authorize us to collect, store and use any information they may give us (e.g., your email address). You will have the option to disable the connection between PhoneArena and your third-party account at any time. When creating a User profile, you may choose to include preferential options such as adding a personal photo. We use your email address to send you updates, news, service-related announcements and contact you on behalf of other Users (such as other Users who send you personal messages). You may choose not to receive e-mails of this type by updating your notification settings on your account, though PhoneArena reserves the right to send you notices about your account even if you opt out of all voluntary email notifications.
Submissions - We store your User profile information, as well as your name, photos, videos and other information you have chosen to display to people in the networks specified in your privacy settings. We store this information so that PhoneArena may present it back to you when you and others when accessing your User profile. Any personal information you voluntarily disclose online may be collected and used by others pursuant to your privacy settings.
Feedback - If you contact us to provide feedback, register a complaint, or ask a question, we will record any personal information and other content that you provide in your communication so that we can effectively respond to your communication. You do not need a User account to contact PhoneArena. Please understand that we are not obligated to compensate you for any feedback you provide.
Personal messaging - In order to allow you to send and receive personal messages to other registered Users of PhoneArena, we record the messages that you send and receive.
Activity - Whether or not you have a User account with PhoneArena, we record information relating to your use of PhoneArena, such as the profiles and gadgets your view, the searches you undertake, which other Users you communicate with, the frequency and size of data transfers, the information you display about yourself, the information you click on, your browser type, IP address, requested URL, referring URL, and timestamp information. If you are logged in, we may associate this information with your User account. We use this type of information to administer the Website and provide the highest possible level of service to you. We also use this information in the aggregate to perform statistical analyses of User behavior and characteristics in order to measure interest in and use of the various areas of the Website. You cannot be identified from this aggregate information.
Cookies - We send cookies to your computer in order to uniquely identify your browser and improve the quality of our service. The term "cookies" refers to small pieces of information that a website sends to your computer's hard drive while you are viewing the site. We may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your computer until you delete them). Persistent cookies can be removed by following your browser help file directions.
Enforcement - We may use the information we collect in connection with your use of PhoneArena (including your personal information) in order to investigate, enforce, and apply our Terms of Service and Privacy Policy.
Please note that we do not collect Personal Information from users under 13 years age. If you are under 13, you should always check with your parents or guardians before giving out any information about you, especially before entering information on any website, mobile application, or online service.
We encourage families to discuss their household guidelines regarding the online sharing of Personal Information. Information Made Available to the Public
When you create a User account, some information about your User account and your account activity will be visible to other PhoneArena Users. This may include your User profile information, as well as your name, email and photo, and other personal information you voluntarily choose to disclose. You may limit the extent to which this information is accessed by adjusting your privacy settings.
Your name and profile picture thumbnail will be available in search results on the Website and those limited pieces of information may be made available to third party search engines. This is primarily so your friends can find you and send a friend request. People who see your name in searches, however, will not be able to access your profile information unless you have allowed such access based on your privacy settings.
Transfer of Information
We may distribute your User-Generated Content to third parties, as permitted pursuant to our Terms of Service. The third parties may in turn publicly display or publish your submissions in connection with their own websites and media platforms. When we distribute your submissions to third parties, we typically include your account name (but not your personal information unless you include your personal information in your submissions).
We may share your personal information with third parties to provide you with services that we offer through the PhoneArena, conduct quality assurance testing, facilitate creation of accounts, provide technical and customer support. These third parties are required not to use your personal information other than to provide the services requested by you.
We may share your personal information with joint ventures or other companies under a common control (collectively, "Affiliates") that we may have now or in the future, in which case we will require them to honor this Privacy Policy. If another company acquires our company or our assets, that company will possess your personal information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.
We may disclose your personal information to third parties in a good faith belief that such disclosure is reasonably necessary to (a) take action regarding suspected illegal activities; (b) enforce or apply our Terms of Service and Privacy Policy; (c) comply with legal process, such as a search warrant, subpoena, statute, or court order; or (d) protect our rights, reputation, and property, or that of our Users, affiliates, or the public. Please note that we are not required to question or contest the validity of any search warrant, subpoena or other similar governmental request that we receive.
We may disclose information in the aggregate to third parties relating to User behavior in connection with actual or prospective business relationship with those third parties, such as advertisers and content distributors. For example, we may disclose the number of Users that have been exposed to, or have clicked on,advertising banners, or number of users that have particular product.
We use third party advertising companies to serve ads when you visit PhoneArena. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.
We may use a third party product for the purpose of determining in which country you are located, so we can provide you with the right option to exercise your privacy rights under the data privacy regulations available in your country. This product includes GeoLite2 data created by MaxMind, available from https://www.maxmind.com

We are a participant in the Amazon Services LLC Associate Program, an affiliate advertising program designed to provide a means for us to earn fees by linking to the Amazon.com and affiliated sites. PhoneArena may include links to other websites as part of content created by PhoneArena (“PhoneArena Content”) or User-Generated Content. PhoneArena does not control or endorse any content of these third party websites, and, by using PhoneArena you agree that PhoneArena is not responsible for the availability or content of such third party websites.
Third Party Advertising
Advertisements that appear on PhoneArena are sometimes delivered (or "served") directly to Users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" or other cross-device tracking technologies, to collect information about you when you use the website on different devices and platforms and to measure the effectiveness of their ads and to personalize advertising content. They may collect information about your online activities over time and across different websites and other online services. Doing this allows the advertising network to recognize your computer or other devices each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. PhoneArena does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on PhoneArena unless you choose to share it with them.
This Privacy Policy covers the use of cookies by PhoneArena and does not cover the use of cookies or other tracking technologies by any of its advertisers.
For example, we use Google to serve ads on PhoneArena. Google uses cookies or unique device identifiers, in combination with their own data, to show you ads based on you visiting phonearena.com and other sites. Controlling Your Personal Data
Although we allow you to set privacy options that limit access to the information on your User profile, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your User profile and information. Therefore, we cannot and do not guarantee that the User-Generated content you post on the Website will not be viewed by unauthorized persons. We are not responsible for the circumvention of any privacy settings or security measures contained on the Website. You understand and acknowledge that, even after removal, copies of your User-Generated Content may remain viewable in cached and archived pages or if other Users have copied or stored your User-Generated Content.
Please also note that the personal messages you send or receive using PhoneArena’s personal messaging feature are only private to the extent that you and the sender/recipient keep them private. For example, we do not have any control over whether a recipient of one of your personal messages publicly posts the contents of such a message.
Accessing, Correcting, or Deleting Your Personal Data
If you are a registered PhoneArena User, you can edit your personal information and your privacy preferences at any time by accessing the "Profile" section of this Website. You can also terminate your User account at any time. Upon request for termination of your account, PhoneArena will use commercially reasonable efforts to close your account, and cease displaying your User-Generated Content on the Website, except for postings that have been shared with others on the Website such as but not limited to discussion comments or products that have become part PhoneArena’s database.
In accordance with applicable laws, and subject to any permitted exceptions and limitations, we will also fulfill any verified request a User submits regarding their personal information by email. To make a verifiable request, you can contact us at privacy@phonearena.com.
Parental Control
If we allow children to create an account or otherwise engage with PhoneArena over time, we will obtain parental consent prior to the collection of their Personal Information. If you are a parent, you can refuse to permit us to collect Personal Information from your child and can request that we delete from our records the Personal Information we have collected. Please keep in mind that a request to delete records may lead to a termination of an account, membership, or other services.

Security
Your account is password protected. We use industry standard measures to protect the personal information that is stored in our database. We limit the access to your personal information to those employees and contractors who need access to perform their job function, such as our customer service personnel. If you have any questions about the security on PhoneArena, please contact us at privacy@phonearena.com .Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that your personal information will never be disclosed in a manner that is inconsistent with this Privacy Policy.
You hereby acknowledge that PhoneArena is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
E-mails and Opt-out
You may opt-out of receiving personal messages from specific Users by changing the notification settings under the “Account” tab after you log on to PhoneArena Unregistered Users who receive e-mails from us may also opt-out of receiving further e-mails by following the instructions contained in our e-mails.
If you do not want to receive advertisements based on usage data collected by PhoneArena, you can opt out of data collection by managing many companies' online advertising cookies. To do that, you can use consumer choices created in some countries' self-regulatory programs, such as the EU Online Choices program (https://www.youronlinechoices.com/) or the US-based DAA and NAI opt-out programs (https://optout.aboutads.info/?c=2&lang=EN and https://optout.networkadvertising.org/?c=1).
Managing the cookies is also possible in your web browser. You can either delete cookies from your cookie folder once you have finished your visit at our website or you can set your preferences with regard to the use of cookies before you begin browsing our website. Please note, that deleting or rejecting cookies may adversely affect your user experience of our website. US Privacy Rights by State
The following section applies only to residents of California, Virginia, Colorado, Connecticut, Utah, Nevada, Texas, Oregon, Montana, and such other U.S. states that have comparable consumer privacy laws.
California Privacy Rights
This section describes your rights if you are a resident of California and explains how to exercise those rights.The California Consumer Privacy Act of 2018 ("CCPA"), amended by the California Privacy Rights Act of 2020 (CPRA), provides you with specific rights regarding your Personal Information. For the purpose of this section, Personal Information has the definition given in the CCPA/CPRA and means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular resident or household. Personal Information does not include: (i) information that is lawfully made available from federal, state or local government records; (ii) de-identified or aggregated data; or (iii) information excluded from the scope of the CCPA/CPRA.

When Do We Sell or Share Personal Information?
We do not “sell” any of your Personal Information in exchange for money. However, the term “sell” has a broader meaning under the CCPA/CPRA than would ordinarily be understood in a non-legal context. We use technologies that help deliver interest-based ads, content and services to you and may transfer personal information to business partners for their use. California law classifies our use of these technologies as a “sale” of your Personal Information to the companies that provide the technologies. Retention of Personal Information
We will retain your Personal Information while you have a User account with us and thereafter for purposes not prohibited by applicable laws, including in line with our data retention and routine business practices. We will then either delete your Personal Information or de-identify it so that it is anonymous and not attributed to your identity.

Right to Know
You have the right to request that we disclose certain information to you about our collection, use, or disclosure of your Personal Information over the past 12 months which features any or all of the following:
- The categories of Personal Information that we have collected.
- The categories of sources from which we collected Personal Information.
- The business or commercial purpose for collecting and/or selling Personal Information.
- The categories of third parties with whom we share Personal Information.
- Whether we have disclosed your Personal Information for a business purpose, and if so, the categories of Personal Information received by each category of third party recipient.

Right to Correct
You have the right to request the correction of any Personal Information we maintain about you.
Right to Access
You have the right to request a copy of Personal Information we have collected and maintained about you. The CCPA/CPRA allows you to request your information from us up to twice during a 12-month period.
Right to Delete
You have the right to request that we delete any of your Personal Information that we collected from you.
Right to Opt Out of Selling or Sharing Your Personal Information
You have the right to opt out of the sale or sharing of your Personal Information. You can exercise this right by visiting the Do Not Sell Or Share My Personal Information link in the footer. If you access this site and/or app from other devices or browsers, or clear your cookies on your devices or browsers, you will need to indicate your preferences again from those devices or browsers. In addition, if you direct us not to “sell” your Personal Information, we will consider it a request pursuant to California’s “Shine the Light” law to stop sharing your Personal Information covered by that law with third parties for their direct marketing purposes.
Right to Opt In of Selling or Sharing Your Personal Information
If we know that you are younger than 16 years old, we will ask for your parent or guardian’s permission to sell your Personal Information before we do so.
Right to Limit Use and Disclosure of Sensitive Personal Information
Subject to certain exceptions, you may have the right to limit our use and disclosure of your Sensitive Personal Information. We do not use or disclose Sensitive Personal Information in a manner that gives rise to this right.
Right to an Authorized Agent
If you would like to make a request on behalf of a California consumer who is a current or former customer, please provide an email from the email address we have on file for the customer authorizing the request. You may also make a request under the CCPA/CPRA with power of attorney pursuant to Probate Code sections 4000 to 4465. We may deny a request from an agent that does not submit proof that they have been authorized by the consumer to act on their behalf.
Right to Non-Discrimination
You are entitled to exercise the rights described above free from discrimination. This means that we will not penalize you for exercising your rights by taking actions such as denying you services; increasing the price/rate of services; decreasing service quality; or suggesting that we may penalize you as described above for exercising your rights.

You may exercise your right to Know, Correct, Access and Delete by emailing privacy@phonearena.com quoting ‘California Privacy Rights' in the subject header and state which right(s) you wish to exercise. We may require additional information from you to help us verify your identity and process your request. Requests may be denied in whole or in part due to various factors including because a request was not verifiable, was not made by a consumer or was made multiple times.
Our Response Time to Your Request
We will make every effort to respond to your request within forty-five (45) days from when you contacted us. If you have a complex request, the CCPA/CPRA allows us up to ninety (90) days to respond. We will still contact you within forty-five (45) days from when you contacted us to let you know we need more time to respond and the reason for the extension.

Depending on the relationship we have with you, we may disclose your Personal Data in ways that may be deemed a “sale” for purposes of the relevant State Privacy laws. We may also share Personal Data with third-party ad-tech providers and others throughout the online advertising ecosystem for purposes of targeted advertising

Right to Know
You have the right to know whether we process your Personal Data.
Right to Correct
Unless you reside in Utah, you have the right to correct inaccuracies in the Personal Data we collect from you, taking into account the nature of the Personal Data and the purposes for which we process it.
Right to Access and Data Portability
You have the right to access and obtain a copy of your Personal Data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another business without hindrance, where the processing is carried out by automated means.
Right to Delete
You have the right to request the deletion of your Personal Data that is collected and maintained by us.
Right to Opt Out of Targeted Ads, Sales to ThirdParties, or Profiling
You have the right to opt out of the processing of the Personal Data for purposes of: (i) targeted advertising; (ii) the sale of Personal Data; or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you, unless you reside in Utah.

Our Response Time to Your Request
We will make every effort to respond to your request within forty-five (45) days from when you contacted us. If you have a complex request, the CPRA allows us up to ninety (90) days to respond. We will still contact you within forty-five (45) days from when you contacted us to let you know we need more time to respond and the reason for the extension.
Right to Appeal
If we decline to take action regarding a request that you have submitted, we will inform you of our reason for declining to take action and, unless you are a Utah resident, provide instructions for how to appeal the decision. In the event that we do not respond to a request that you make pursuant to one of the privacy rights set forth in this section, unless you are a Utah resident, you have the right to appeal our refusal to take action within a reasonable period of time after you receive our decision. Within 60 days (45 for residents of Colorado) of our receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If the appeal is denied, we will also provide you with an online mechanism, if available, or other method through which you may contact your state attorney general’s office to submit a complaint.
Nevada Privacy Rights
If you are a resident of Nevada, you have the right to opt out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. We do not currently sell your Personal Data, as defined by Nevada Law, for monetary compensation to third parties for their own purposes. However, Nevada residents may request that we include their name on a do-not-sell list in the event we were to do so in the future. European Privacy Rights
This section applies to you if you are an individual located within the European Economic Area (EEA), United Kingdom (UK) or Switzerland from whom we may have collected Personal Data from any source, including through your use of our Website and services. The section is included to comply with the requirements of the General Data Protection Regulation (GDPR), the UK GDPR, and related laws, regulations, and guidance from the European Union and/or its member states. For the purpose of this section, Personal Data has the definition given in the GDPR and means any information relating to an identified or identifiable natural person.
Data Controller
PhoneArena is the data controller, as defined under the GDPR, of all Personal Data of individuals within the EEA, Switzerland or the UK that is collected through our Website and services.
Legal Basis for Processing Your Personal Data
We will only process your Personal data when the law allows us to, most commonly in the following circumstances:
- Where it is necessary to perform our contractual obligations to you, including, but not limited to those obligations in our terms of use.
- Where it is necessary to pursue our legitimate interests as further detailed in section "Legitimate interests" below.
- Where you have consented to a certain use of your Personal Data, which you may withdraw at any time.
- Where we need to comply with a legal or regulatory obligation.
To the extent permitted under applicable laws, we will also process, transfer, disclose, and preserve Personal Data when we have a good faith belief that doing so is necessary.
Legitimate interests
Legitimate interests means the interests of our company in conducting and managing our organization. We may collect, process and maintain Personal Data to pursue the legitimate business interests outlined below:
- Provide, improve, and develop our Website and services, including to send you messages and provide user support, customize the services to better fit your needs as a user, develop new services, and perform internal analytics and research and development. This also includes sharing Personal Data with our trusted service providers that provide services on our behalf.
- Protect you and others and to create and maintain a trusted environment, such as to comply with our legal obligations, to ensure compliance our agreements with you and other third parties, to ensure safe, secure, and reliable services, and to detect and prevent wrongdoing and crime, assure compliance with our policies, and protect and defend our rights, interests, and property. In connection with the activities above, we may conduct internal research and profiling based on information obtained from third parties.
- Provide, personalize, measure and improve our marketing, including to send you promotional messages and other information that may be of interest to you with your consent. We may also use Personal Data to understand our user base and the effectiveness of our marketing. This processing is done pursuant to our legitimate interest in undertaking marketing activities to offer products or services that may be of interest to you.
When we process your Personal Data for our legitimate interests, we make sure to consider and balance any potential impact on you, and your rights under data protection laws. Our legitimate interests do not automatically override your interests. We will not use your Personal Data for activities where our interests are overridden by the impact on you, unless we have your consent or those activities are otherwise required or permitted to by law. Right of Access
You have the right to find out what, if any, Personal Data we have about you, how we process it, and to request a copy of the Personal Data.
Right of Rectification
You have the right to have the Personal Data we hold about you corrected if it is factually inaccurate, though we may need to verify the accuracy of the new data you provide to us.This right does not extend to matters of opinion, such as views expressed in editorial content.
Right to Erasure

Please note that in order for you to assert these rights, we may need to verify your identity to confirm your right to access your Personal Data. This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. While verifying your identity, we may need to gather more Personal Data from you than we currently have. If a third party is making a request on your behalf, we will ask them to prove that they have your permission to act for you.
